PURCHASING ACTUALTHING PRODUCTS
By placing an order for a product or by selecting a service on this website and therefore following the purchasing procedure on this website, you are entering into a contract with Actualthing Ltd.
As a customer you will have opportunities to double-check, change your selection or adjust any inputs regarding your order, right up until you click on the ‘Purchase’ button. Directly after you have submitted your order we will send you a payment confirmation by email message.
The credit card issuer, bank or financial institution that you use for a purchase may charge a fee for international transactions, unfortunately we have no influence or control over any fee charged.
At Actualthing Ltd. we reserve the right to decline all or part of your order for whatsoever reason and should this occur we will contact you with our reasons. In the unlikely event that we do decline your order, we will of course return any monies paid (should we have already received payment for the product).
OUR PRICING
The product price on this website is the price you will pay for your purchase. Delivery charges are calculated as part of the checkout process, and this cost is based on your location and any preferred and specified requirements. We currently offer free delivery to UK addresses, for worldwide destinations we will calculate the cost and offer you options after receiving your order. if you do not accept the delivery cost then you are able to cancel your order.
Local sales taxes (such as those in the US) will be calculated and added to the final delivery/shipping cost (above). this will be confirmed by email.
If we discover an error in the price of the products and/or services we will of course inform you as soon as possible.
Actualthing Ltd. will only take payment from your card or payment method once you have entered your payment details and have clicked the ‘Purchase’ button, (subject to card authorisation).
If you would rather contact us directly with an order please use the Contact page and we will be happy to undertake communications to enable a direct purchase with us. This method might be easier for non-UK customers so that we can discuss shipping costs and taxes at the same time.
SITE VISITS
In some cases the installation site will require a visit from an Actualthing representative for consultation reasons. We do not currently offer an installation service. If a site visit is required this can be arranged and agreed in advance of, or to coincide with, delivery of the purchased product(s).
AVAILABILITY AND DISPATCH DATES
We advise a six-week delivery date for our products as each is made strictly to order. We aim to be faster if possible, but any information or dispatch estimates on the website in relation to products or services are approximate. As we process your order, we will inform you by email if any products can be delivered sooner.
We’d appreciate your understanding that we cannot begin building your product until we have received your full payment.
You will receive an Order Shipped email before dispatch.
COLLECTION
You are very welcome to collect your product from us directly, by appointment. If this is your preferred option please indicate this when purchasing by email.

This will explain fully how we deal with your personal information. We take your privacy very seriously.
Credit and debit card payments that are made on this website are protected by a secure connection. This secure connection ensures that your credit and debit card information is encrypted prior to it being transferred to the bank for authorisation.
CANCELLATION AND RETURNS
Once you place and confirm your order by selecting ‘Purchase’ we begin building and assembling your order specifically for you and your requirements. We’d prefer you took a little more time to consider your purchase if you are in any doubt before purchasing.
UK customers and those within the EU
In all cases our products are made to order and work begins immediately after payment, and so after 14 days we do not offer refunds for change of minds.
If your Actualthing order is being delivered to a country in the EU, under the Consumer Contracts Regulations, if you cancel your order in writing within 14 days of receipt of your order, this legislation entitles you to a full refund including the original delivery cost (if any). This also applies to orders cancelled before they are dispatched.
In order to cancel your order you must contact us by email or in writing.
If you wish to damaged items for a refund they must be returned in their original packaging. We recommend that the return delivery is insured as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them. We also recommend that you use a reliable, trackable means to return your order to us.
Refunds will be paid in the same form originally used for the purchase as soon as possible, but in any event within 14 days.
We reserve the right to make a charge not exceeding our direct costs of recovering the products in the event that you do not return the products or you return them at our expense. We may deduct this charge from the refund.
Please note that this cancellation policy does have some limitations and does not apply to business customers or to private customers situated outside the European Economic Area.
US customers
Once products ship from the UK, all sales are final. We will accept cancellation of your order for items that have not shipped within 14 days of your order. If you wish to cancel your order you must contact us. You will then be entitled to a refund, which will be paid in the same form originally used for the purchase, but in any event within 30 days.
Damaged or incorrect products will be replaced by Actual as described below. However, the return or exchange of items ordered in error is not permitted.
Private customers (outside the European Economic Area) and business customers
For private customers (outside the European Economic Area) and business customers we will only accept returns if we are informed in writing within 24 hours of delivery.
You must arrange and pay the costs of returning the item(s) to Actualthing. A handling charge of 10% of the total value of your order will be made. While in your possession, you must keep any items you intend to return to us in good, unused, condition, and in their original packaging.
MISSING, DAMAGED, FAULTY OR INCORRECT ORDERS
Missing features or details
If any item is missing from your purchase delivery, please notify us within seven days of delivery. If we need to send you the item you will not incur an extra delivery charge.
Damaged or incorrect products
Please study the condition of the boxes your product came in on delivery. If any packaging has been damaged during delivery, please take a photo of the damage and make note of this on the courier’s paperwork before signing before opening them.
Please open the delivered boxes immediately to check the contents. Should you open the boxes to discover that the items inside have been damaged in transit, please take photos and contact us about the damage within 24 hours of receipt of your order.
When we have received the damaged or incorrect items at Actualthing, we will either replace the damaged or incorrect products or refund the price (including delivery costs) to you. Provided the above conditions are met we will refund the cost of such returns (this applies to the UK only).
Refunds
All refunds will be credited using the original payment method.
Statutory rights
This returns policy does not affect your statutory rights. Further information about your rights is available from your local authority Trading Standards Department or Citizen Advice bureaus.
COLOUR, MATERIAL AND FINISHES
The natural qualities of timber means that there will be naturally occurring variations in colour, and this colour may change over time due to UV light. All our timber is sealed using natural beeswax but sunlight may lighten or darken colours depending on the installation environment.
Please do not subject our timber luminaires to heat, humidity or moisture.
INSTALLATION
Our products are designed to be installed with relative ease. All components are delivered with the exception of fastenings (screws, rawplugs etc). Please use a qualified electrical engineer or installer for your luminaire product. Actualthing Ltd. cannot accept responsibility for your (or your contractor’s) workmanship.
Dismantling
We firmly suggest that in the case of moving home that GEO900 or ten30 products are carefully dismantled taking care not to break the bulb or disrupt any cabling. We cannot accept responsibility for damage caused to our products if moved whilst assembled.
Liability
Please observe and follow the installation instructions that accompany our products.
GEO900 and ten30 could fail if the instructions contained in our installation documents are not followed precisely. We are unable to accept liability for systems that are not fixed according to our instructions.
We are not able to accept liability for the poor condition of walls, floors or ceilings into which the products are installed. If you choose to over-rule our installation advice, we will be unable to accept any liability for a subsequent failure in your wall/floor/ceiling and Actualthing product.
INTELLECTUAL PROPERTY
The content of our website is protected by copyright, trade-marks, database and other intellectual property rights and is made available for your personal non-commercial use only. You may (if necessary to place an order) download such content onto one computer hard drive or print one copy of such content for your non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use any of the content on this website without written permission from Actualthing Ltd.
LIMITATIONS
Nothing in these Terms and Conditions shall exclude our liability for personal injury or death caused by its negligence.
We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
(a) the loss or damage was not foreseeable to both parties when the contract was formed;
(b) the loss or damage was not caused by any breach on the part of Actualthing Ltd. ; or
(c) the loss or damage relates to business or non-consumers, to the extent that such loss or damage exceeds the price of the products in respect of which the claim relates.
DISCLAIMERS
We promise that we will operate this website with reasonable skill and care and that we will use our reasonable endeavours to correct any faults of which we are aware.
We do not make any promises about the availability of the website. In particular we disclaim any liability in connection with any technical problems you may experience with the website which may result in interruptions to the website, or any bugs or viruses in the website or the server that makes it available.
We do try to ensure that the information on the website is accurate and complete, but sometimes mistakes occur and we therefore do not accept any liability which may arise as a result of any such errors or incomplete information.
Actualthing Ltd. will not be liable for any damage caused by circumstance beyond its reasonable control, including but not limited to acts of God, war, riot, embargoes, acts of civil or military authority, rain, fire, flood, accidents, earthquake(s), strikes or labour shortages, transportation facilities shortages or failures of equipment, or failures of the Internet.
AMENDMENTS OF THE TERMS AND CONDITIONS
These conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.

EXPORTING OUR PRODUCTS
Regarding deliveries we will charge you the cost of shipping. Actualthing only covers the cost of shipping which we pass on from the shipping and courier companies we use. On your behalf we will endeavour to use the most cost-effective and efficient shipping companies.
All orders are dispatched from Actualthing Ltd. in the United Kingdom. Once your goods have cleared local customs, you will be contacted by the shipping representative to make detailed delivery arrangements.
You may be liable for local import duties, taxes and/or customs fees, which are charged by your government. Within some jurisdictions outside of California or New York State, you may be liable for a payment of use tax in lieu of sales tax. We have no control over these charges and cannot predict what they may be. If in doubt, you should contact your local customs office.
You are considered to be the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.
Please note that our couriers will be able to deliver goods into your home, business or storage facility but they are not responsible for unpacking of items or removal of packing materials.
COMPLAINTS
Should you have any complaints or have any questions, please contact us. All complaints will be dealt with fairly, effectively and confidentially. Your statutory rights as a consumer are unaffected.
